Emotional states that influence a traffic accident and must be taken into account when judging

Abstract

The research analyzes the importance of considering the psycho-emotional states of individuals involved in traffic accidents, especially when they are deemed responsible for the incident. Through a quantitative approach and a non-experimental descriptive design, a survey was administered to 30 individuals, whose results indicate that emotional aspects are not being adequately considered in expert reports or in judicial processes. Although there is trained personnel capable of conducting such evaluations, forensic practice has focused on a technical approach, overlooking relevant human factors. This study does not seek to exempt offenders from responsibility, but rather to propose that the emotional component be considered as a complementary element that may influence judicial assessment, allowing for more fair and contextualized decisions.
